Board Members Present: Al Binsfield, John Clark (Vice Chair), Lynne Dowling (Secretary), Dennis Riggs, Rande Swann (Chair)

City of Prospect Personnel Present: Prospect City Attorney Chris Gorman, who introduced Prospect City Consulting Environmental Attorney Max Bridges (Wyatt, Tarrant, and Combs, LLP, Louisville)

The meeting began at 6:00PM.

Declaration of Quorum was made by Swann as Chair.

A motion was made by Clark, seconded by Riggs, and unanimously passed to amend as drafted, the minutes presented for the March 23, 2022 meeting.

Old Business

Code Enforcement Board Case No. 22-2-1: Citation for Nuisance Violation at 7301 Fox Harbor Road, Prospect, KY. City Attorney Gorman reported he had lengthy conversations with the son-in-law and daughter of the Cited Resident.  The daughter said she is committed to taking care of everything on the property when the weather breaks.  She noted her mother had been diagnosed with Alzheimer’s and intends to prepare the property for sale in the near future.  In light of this agreement to cooperate, Swann proposed the Code Enforcement Board give the Cited Resident at least another 30 days to implement the needed property improvements, considering the challenges securing ground help near Derby.  Riggs moved and Clark seconded a motion to extend the deadline and it was unanimously passed.

At 6:06 PM the Board moved to Executive Session to discuss pending litigation on Code Enforcement Board Case No. 21-11-1: Citation for Violation of Nuisance Ordinance located at 7513 Rockingham Road, Prospect, KY.

At 6:33PM, the Board Reconvened from Executive Session after discussion. Gorman read a Finding of Fact document.  Riggs moved and Binsfield seconded a motion that was unanimously passed to accept the Findings of Fact.  Riggs moved and Dowling seconded a motion that unanimously passed to assess the Cited Resident with a fine of $50.00 a day, starting April 11, 2022 and continuing daily until said fine is paid and/or the property is remediated to the satisfaction of the City of Prospect Code Enforcement Board.

There being no further business before the Board, Riggs moved and Clark seconded a motion to adjourn, which was unanimously passed.
