Board Members Present: Al Binsfield, Lynne Dowling, Secretary, Paul McDaniel (Alternate for John Clark, Vice-Chair), Dennis Riggs, Rande Swann (Chair)

City Personnel Present: Police Chief Jeff Sherrard, Prospect City Attorney Chris Gorman

Those signed in and addressed the Board: Jacqueline and John McGrail, 7513 Rockingham Rd; Christy Geddes, 6415 Deep Creek Dr.

  • The meeting began at 7:01 PM. Swann noted John Clark was absent, but McDaniel, the Official Alternate was present. Binsfield moved and Dowling seconded a motion that McDaniel serves as Alternate for Clark for this meeting, and it was unanimously approved.
  • Declaration of Quorum was made by Swann as Chair.
  • A motion was made by Riggs, seconded by McDaniel and unanimously passed to approve, with no changes, the minutes presented from the December 15, 2021 Code Enforcement Board Hearing.
  • McGrail requested her letter to Swann and Gorman dated December 17, 2021, be added to the exhibits of the December 15, 2021 meeting. A motion by McDaniel and seconded by Dowling unanimously passed to include the December 17, 2021 letter in the Exhibits section of the approved December 15, 2021 minutes. Said exhibit will be added as Exhibit B12.
  • McGrail remarked she could not find the December 15 minutes online. Swann explained minutes are not posted publicly until they have been approved.
  • At 7:15 PM Binsfield moved and McDaniel seconded a motion unanimously passed to adjourn to Executive Session. Swann asked non-Board attendees to leave the Council Chambers until called back.
  • Executive Session concluded at 7:53 PM and the other attendees were invited to reconvene in Council Chambers.
  • Upon resuming the open session, Chair Swann made a motion to approve as a finding of fact that McGrail violated the Nuisance Ordinance 92.03(g). The motion was seconded by Dowling and passed unanimously.
  • A second motion was made by Riggs, seconded by McDaniel, and passed unanimously that the attendant fines be deferred for 30 days beginning February 7, 2022, to allow Ms. McGrail time to submit to the Board a proposed altered landscape plan, which includes lawn and defined plant beds, that meet the Code and established standards. When or if the plan is approved, the Board agreed to grant McGrail an additional 60 days to implement the plan.
  • Swann remarked the Board is willing to work with McGrail and will bring in an outside third party familiar with subdivision gardening to help develop the plan.
  • There being no further business before the Board, Binsfield moved and McDaniel seconded a motion that passed unanimously to adjourn at 8:10 PM.
