Board Members Present: Al Binsfield, John Clark, acting Secretary, Paul McDaniel (Alternate for Lynn Dowling, Secretary), Rande Swann (Chair)

City Personnel Present: Prospect City Attorney Chris Gorman

Cited Resident: Jacquelyn H. McGrail, in attendance via WebEx

  • Those signed in to address the Board: No residents were present.

  • The meeting began at 6:00 PM. Swann noted Lynne Dowling was absent, but McDaniel, the Official Alternate was present. Clark moved and Binsfield seconded a motion that McDaniel serves as Alternate for Dowling for this meeting, and it was unanimously approved.

  • Declaration of Quorum was made by Swann as Chair.

  • A motion was made by Clark, seconded by McDaniel and unanimously passed to approve, with no changes, the minutes presented from the February 7, 2022 Code Enforcement Board Hearing.

  • Chair Swann detailed a meeting where she and Lynne Dowling met with Ms. McGrail, Tavia Cathcart of the Creasey Mahan Nature Preserve, and Julie Grinnell of Greenscapes, the City’s landscaper. Expectations were discussed and it was agreed that her date to come back to the Board would be extended to March 31, 2022. Swann noted that good progress was made

  • A motion was made by Swann, seconded by McDaniel, and passed unanimously that in the matter of CEB Case No. 21-11-1, for the violator McGrail that the timeline that was extended for 30 days, be further extended to Thursday, March 31, 2022, for the violator, Ms. McGrail, to submit a new landscaping plan to the Code Enforcement Board.

  • City Attorney Gorman remarked that there is a time frame of 20-30 days to appeal the final ruling of the Board to the District Court. That being the case, he will defer drafting a final order until March 31, 2022, at the earliest and notify Ms. McGrail’s, Counsel, Ryan Fenwick of such.

  • There being no further business before the Board, Binsfield moved and McDaniel seconded a motion that passed unanimously to adjourn at 6:04 PM.
