Board Members Present: Al Binsfield, John Clark (Vice Chair),Lynne Dowling (Secretary) Dennis Riggs, Rande Swann, (Chair).

City Personnel Present: Prospect City Attorney Chris Gorman, Prospect City Code Enforcement Officer Rick Wilson

  • The meeting began at 7:02 PM.
  • Declaration of Quorum was made by Swann as Chair.
  • A motion was made by Riggs, seconded by Binsfield, and unanimously passed to approve, with no changes, the minutes presented from the March 7, 2022 meeting.
  • New Business
    • City Attorney Gorman asked Swann if there was any recent contact with McGrail, to which Swann responded no.
    • In response to a question from Swann, Prospect Code Enforcement Officer Rick Wilson affirmed the date and time of this CEB Hearing was provided to both the Cited Resident, Mrs. Sprague, and her son-in-law; however, neither were present to respond.
    • Wilson reviewed the activities-to-date timeline and provided copies of photos and the original citation to be entered as exhibits to the file. Dowling asked for clarification of the extent of the items covered within the violation and agreed it was sufficiently inclusive. Swann noted the son-in-law of Cited Resident claimed to hold Power of Attorney for the Cited Resident, and asked Gorman if there was any way to verify the POA status of the son-in-law, or whoever is responsible legally for the Cited Resident. Gorman indicated he would call the son-in-law within the next 24 hours. He recommended delaying discussion of the issue in Executive Session for two more weeks while providing the family of the Cited Resident with specific objectives for acceptable remediation of the current violations. The recommendation also was made to provide a list of assistance agencies to the Cited Resident’s family. Swann noted a decision for further action will be deferred until after Gorman had the opportunity to speak with the family of the Cited Resident.
  • There being no further business before the Board, Dowling moved and Clark seconded a motion to adjourn, which unanimously passed.
  • Meeting adjourned at 7:38 PM.
